Shabbat.com is a website and mobile app (including the Seder App) dedicated to bringing together prospective Shabbos hosts, who wish to share the beauty and joy of their Shabbos experience, and individuals (prospective guests) looking to partake in a Shabbat experience. To accommodate both prospective hosts and prospective guests, we’ve created two databases (two registration processes), one for each, and the rules that apply to each differ. Please take note to understand the rules that apply to each prior to completing the registration process. For your convenience, we have separated the rules that apply to you as a Guest from those that apply to you as a Host in the Terms of Use below. All other rules outlined in the Terms of Use will apply to all users equally. Please note that the two designations (Host & Guest) are not mutually exclusive. That is, you may choose to be a host on a particular Shabbos and also wish to experience Shabbos as a guest at the homes of other families on another. We encourage our users to experience Shabbos both as guests and hosts, as each presents differing opportunities and perspectives on the Shabbos experience.
We are excited by the endless possibilities and opportunities presented by this website, and we hope all your experiences in connection with this Website will be positive and uplifting. In order to ensure our users’ positive experiences, we’ve created a set of rules by which users must abide. Together, these rules and conditions form a legal contract between you, other users, and us. As a contract, the language is cold and clinical at times. Please do not be offended by that. Our mission is to bring joy and beauty to Shabbos experiences around the world, and we’re here to help make that happen.
In the Terms of Use (the contract), the term “you” and “user” refers to all users of this Website, including Hosts and Guests. The purpose of these rules is to create a comfortable, respectable, and safe atmosphere where Hosts and Guests can connect. Additionally, it is important for us to make clear, and for you to fully understand, that we cannot, nor do we, take any responsibility for any actions of other users or third parties. As such, when you offer or accept an invitation, any risks associated with the same is entirely yours. Please be sure to read the Warranties and Disclaimers in our Terms of Use for more information prior to offering or accepting an invitation, and of course, please take all precautions to keep yourself safe.
ACCEPTANCE OF TERMS
Shabbat.com makes this website, Shabbat.com (the “Site”), including all information, documents, mobile apps (including the Seder App), communications, files, text, graphics, photographs, software, products and services available through the site (collectively, the “Materials”) and all services offered by Shabbat.com and third parties, including individuals registered as Shabbos Hosts on the Site, through the site (collectively, the “Services”), available for your use subject to the terms and conditions set forth in this document and any changes to this document that Shabbat.com may publish from time to time (collectively, the “Terms of Use”).
By accessing or using this Site in any way, including, without limitation, registering as a Guest or Host, use of any of the Services, downloading of any Materials, or merely browsing the Site, you agree to and are bound by the Terms of Use.
Shabbat.com reserves the right to change the Terms of Use and other guidelines or rules posted on the Site from time to time at its sole discretion. Your continued use of the Site, or any Materials or Services accessible through it, after such notice has been posted constitutes your acceptance of the changes. Your use of the Site will be subject to the most current version of the Terms of Use, rules and guidelines posted on the Site at the time of such use. You should periodically check these Terms of Use to view the then current terms. If you breach any of the Terms of Use, your authorization to use this Site automatically terminates.
DEFINED TERMS
The term “Host” means an individual registered on the Site as a Host, and the term “Guest” means an individual registered on the Site as a Guest. All user-supplied information, materials, files, communications, guest-book entries, comments, and photographs are referred to collectively as “User Content.” “Shabbat.com Content” means all Materials provided by Shabbat. User Content and Shabbat.com Content may have different restrictions and conditions associated with them.
The terms and conditions expressed in this agreement apply to all users and visitors of this Site.
By creating a User account on the Site you are representing that you are at 18. If you are under the under the age of 18 years you are NOT permitted to use this Site.
GUEST PROFILES, RULES; REGISTRATION
Standard Guest Profile. In order to create a standard profile, in addition to the information you would need to provide to create a Quick Guest profile, you will also need to provide the following information: your city, state, zip code, 2 references, dietary needs, and one picture. The Standard Guest profile allows you to include some optional information such as your occupation and general information about yourself. Shabbat.com shall be the final arbitrator as to whether a particular uploaded photograph is appropriate given the nature of the Site, and Shabbat.com shall have the right to delete any photographs it deems, in its sole discretion, to be inappropriate. Please note that, upon registration, the default setting allows for other Users, namely prospective Hosts, to view your profile and offer the Guest a Shabbos invitation. This setting may be changed once you are logged in to your account.
With a Standard Guest profile you will have the ability to submit direct requests to prospective hosts. Once a host accepts a request and confirms a reservation, contact information will be shared between the Host and Guest.
HOST RULES; REGISTRATION
To register as a Shabbat.com Host, complete and submit the registration form. You will be required to include all the information required to create a Standard Guest profile (See Section 4(B)). AGE: You must be at least 18 years or older to create a profile without the express verified consent of your guardian. To complete a Host profile you must upload at least one picture. The Host profile allows you to include some optional information about your family. Please use your discretion when uploading information about your family as we are unable to screen the Site users or to vouch for their integrity.
RIGHT TO REMOVE MEMBERS
We reserve the right to reject any individual for any reason we see fit.
There is no missionizing on Shabbat.com, Christian or otherwise. Any member reported or found to be missionizing will be removed from the site.
There will be no sexual solicitation on Shabbat.com. Members who feel solicited or pressured must repost the incident and the offending party will immediately be removed from the site.
Shabbat.com members are not to pressure other members to engage in an unsolicited or unwanted relationship. Pressuring members, making them feel uncomfortable reflects poorly on the spirit of Shabbat.com. Offending party will immediately be removed from the site.
Shabbat.com is not a commercial site. While occasionally Shabbat.com may allow commerce posts and solicitations to remain, we reserve the right to delete these posts as well as to remove members who abuse this feature.
INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS
The Materials and Services on this Site, as well as their selection and arrangement, are protected by copyright, trademark, patent, and/or other intellectual property laws, and any unauthorized use of the Materials or Services at this Site may violate such laws and these Terms of Use. Except as expressly provided herein, Shabbat.com does not grant any express or implied rights to use the Materials and Services. You agree not to copy, republish, frame, download, transmit, modify, distribute, license, reverse engineer, or create derivative works based on the Site, its Materials, or its Services or their selection and arrangement, except as expressly authorized herein. GOVERNING LAW AND JURISDICTION
This Site (excluding linked sites) is controlled by Shabbat.com from its offices within the state of New Jersey, United States of America. By accessing this Site, you and Shabbat.com agree that all matters relating to your access to, or use of, this Site shall be governed by the statutes and laws of the State of New Jersey, without regard to the conflicts of laws principles thereof. You and Shabbat.com also agree and hereby submit to the exclusive personal jurisdiction and venue of the Courts within the State of New Jersey with respect to such matters.
GENERAL
The Terms of Use and the other rules, guidelines, licenses and disclaimers posted on the Site constitute the entire agreement between Shabbat.com and you with respect to your use of the Site.
